Woman back in jail after making plea deal in 2020 robbery, murder
One of the six subjects who made a plea deal in a 2020 fatal home invasion is back in jail.
Toni Nicole Toole, a suspect in the fatal home invasion which killed Cross Henderson in Upatoi of 2020, pled guilty to two counts of robbery in February of this year. The Ledger-Enquirer reported Toole entered a “cold plea,” meaning prosecutors agreed to no sentencing recommendation in exchange for their pleas. The maximum sentence for robbery is 20 years in prison.
Two months later, Toole was arrested and charged with one count of simple battery-family violence, which as of now is a misdemeanor charge. Court records suggest she was booked into the jail on Sunday, April 9, 2023, and posted a $1,000 bond the following day, Monday, April 10, 2023. Her first court appearance is expected to be held tomorrow, April 12, 2023, at 2:00 P.M. with Judge Julius Hunter.
If Toole is found guilty of the charge of simple battery-family violence, she could face up to one year in jail and a fine up to $1000.
