BREAKING: Alabama Price Gouging Law takes effect ahead of Hurricane Isaias
Alabama Attorney General Steve Marshall announced that the state’s price gouging law is now in effect following Gov. Kay Ivey’s declaration of a State of Emergency ahead of Hurricane Isaias.
The emergency declaration took effect at 4 p.m. Wednesday, October 7, and covers 40 Alabama counties. The declaration activates Alabama’s price gouging law, which prohibits unconscionable price increases on goods and rental facilities during a declared State of Emergency.
Marshall said his office will monitor reports of potential price gouging through October 14, warning businesses and individuals against taking advantage of residents preparing for or recovering from the storm.
Alabamians are encouraged to watch for excessive price increases involving emergency supplies, as well as repair and cleanup services that may be needed because of Hurricane Isaias.
Under Alabama law, a price that is at least 25% higher than the average price charged for the same item or service in the same area during the previous 30 days may be considered evidence of price gouging, unless the increase can be attributed to a reasonable cost increase. The law does not define an unconscionable price solely by a specific percentage.
Violations can result in fines of up to $1,000 per violation. Businesses or individuals found to have willfully and continuously violated the law may also be prohibited from doing business in Alabama.
Residents in affected counties who suspect price gouging can submit a complaint through the Alabama Attorney General’s website at http://www.alabamaag.gov by selecting the consumer complaint link.
Consumers can also contact the Attorney General’s Consumer Interest Division toll-free at 1-800-392-5658 to report suspected violations.
As Hurricane Isaias approaches the Gulf Coast, state officials are urging residents to remain alert for potential scams and unfair pricing while purchasing emergency supplies or arranging storm-related repairs.
